German Woman Jailed for Insulting Rapist in WhatsApp Messages

In a recent case that has sparked significant public outrage, a young German woman received a harsh punishment for insulting one of the nine men convicted of the gang rape of a 15-year-old girl in a Hamburg park in 2020.

The case highlights the strictness of German laws regarding verbal insults and has raised questions about the proportionality of justice.

Maya R., a 20-year-old resident of Hamburg, was sentenced to several days in prison for a series of messages she sent via WhatsApp. In these messages, she referred to one of the perpetrators involved in her gang rape as a “disgraceful pig” and a “disgusting freak”. This incident has drawn attention due to the comparatively lenient punishment handed down to the rapist, who received a suspended sentence.

The Telegraph reported that the incident leading to Maya’s imprisonment occurred after she sent a message to one of the nine men convicted of the gang rape of a 15-year-old girl in a Hamburg park in September 2020. The rapist, whose number had been published online, was called out by Maya in a series of angry and derogatory messages.

In one message, Maya wrote, “How do you not feel ashamed when you look in the mirror? Let’s hope you just get locked up.” She also threatened that the rapist would not be able to walk the streets without being punched in the face.

Maya’s sentence was influenced by her prior record, which included a theft charge for which she failed to appear in court. Despite apologising to the rapist and expressing regret over her actions, Maya received a harsher sentence than the rapist who received her messages.

The rape case in question involved nine young men who assaulted a 15-year-old girl for several hours. All the perpetrators were under 20 years old at the time, and most were given suspended sentences, with only a 19-year-old Iranian national sentenced to actual imprisonment. None of the convicted men, including the one who received Maya’s messages, showed remorse for their actions.

The judge in the case noted that the men’s lack of remorse was particularly concerning. However, the public’s reaction has been sharply critical of the legal system’s response, particularly the disparity between Maya’s punishment and the rapists’ sentences.

This case has thrown a spotlight on the severity of Germany’s laws against insults. Under German law, even calling someone an “idiot” can result in a prison sentence of up to two years. The court handling Maya’s case has reported a “disturbingly harsh” public reaction, describing the backlash as a “targeted attack on the rule of law”.

A spokesperson for the district court told the local newspaper Hamburger Abendblatt, “We are observing with great concern the hostility associated with this case and the verdict.”
